INFORMATION ON THE PROCESSING OF PERSONAL DATA

Pursuant to Art. 13 of Regulation (EU) 679/2016 (the “GDPR”)

This page describes the characteristics of the processing of personal data of users (the “Users“) of the website https://www.dalmonte.info (the “Site”).

2 – Methods of data collection and types of data processed

Browsing data automatically collected by the Site: login and navigation data

Whenever Users access the Site, the computer systems and software procedures in charge of the Site’s operation acquire, in the course of their normal operation, access and navigation data (for example: information about the browser used by the User, pages visited, date, time and duration of each visit, as well as other parameters related to the User’s operating system and computer environment – the “Navigation Data“).

Data reported by Users: registration data as “new user”

Through the “Warranty Extension” section, users can register for the Site by entering their e-mail address and password on an initial screen. After registration, Users are given the opportunity to update their web profile by adding additional personal data (i.e., first name; last name; country; city; gender) (the “Disclosed Data“).

Navigational Data and Communicated Data, jointly referred to as Personal Data.

Cookies

Computer techniques are used in the Site for the direct acquisition of personal identification data of the user consisting of “strings of code”: cookies.

The legal bases for the processing of personal data in this context are Art. 6 (1) lit. c GDPR and Art. 6 (1) lit. f GDPR. Our legitimate interest is in the management of cookies and similar technologies used and related consents.

The provision of personal data is neither contractually required nor necessary for the conclusion of a contract. You are not obliged to provide personal data. If you do not provide personal information, we will not be able to handle your consents.

3 – Purpose and legal basis for processing

Navigation Data will be used: (i) in order to monitor the proper functioning of the Site, (ii) in an anonymous and aggregate form, for statistical purposes related to understanding how the Site is used by Users, to improve ease of access, and to increase its attractiveness; and (iii) To detect any technical problems as soon as possible.

Said processing has its legal basis in the Company’s legitimate interest in the improvement of its digital products and services, and is compatible with the position of data subjects in that: (a) monitoring the operation of the Site and statistical data related to its use does not involve direct identification; and (b) the Company’s interest reasonably appears to be proper also to Users, who will thus be able to enjoy an increasingly
performant and optimized.

Data voluntarily transmitted by Users, will be used exclusively for: (i) give feedback to a User’s request for an extended warranty for a purchased product; (ii) Send an informative newsletter to users.

The legal basis for this processing is the need to respond to Users’ requests, execute pre-contractual and possibly contractual measures taken at the User’s request, and fulfill related legal obligations; as well as specific consent regarding the sending of the newsletter.

4 – Recipients of the communication of Personal Data

Personal Data will be disclosed and may be known to the following. (i) by employees and contractors of the Company, duly trained and/or designated for processing; and (ii) by third parties who provide services ancillary or instrumental to the Company’s activities, in connection with the development, delivery, maintenance and operational management of the Site, specifically appointed as data processors.

5 – Place of processing and transfer abroad of Personal Data

The processing of the User’s Personal Data will take place at the aforementioned Company’s headquarters, and the Personal Data will be stored at servers located within the European Union.

Any further transfers of Personal Data abroad will take place, if to countries that do not benefit from an adequacy decision of the European Commission and, therefore, do not offer an adequate level of protection for Personal Data, only (i) subject to the adoption of appropriate safeguards such as, but not limited to, signing the standard clauses approved by the European Commission, or (ii) upon the occurrence of an exception to the prohibition of transfers outside the European Union and, therefore, again by way of example, subject to the collection of the explicit and informed consent of the User, or only to the extent necessary for the performance of a contract concluded between the User and the Company, or between the Company and a third party for the benefit of the User, or for the performance of pre-contractual measures taken at the request of the User.

6 – Method of processing, security measures and storage period of the Personal Data

Personal Data will be processed both in paper form and by electronic, computer or automated means, through systems that ensure its protection, security and confidentiality.

In addition, the Company has adopted specific and adequate logical, legal organizational and technical security measures to prevent the loss of Personal Data, unlawful or unauthorized use of the same and unauthorized access

Browsing Data – which do not allow the identification of Users – do not persist for more than 1 week and are deleted immediately after their aggregation (subject to any need for the investigation of crimes by the competent Judicial Authority);

Disclosed Data will be retained for longer periods of time where necessary to: (i) to execute contractual/pre-contractual measures and for the duration of any contractual relationship with the Company; (ii) fulfilling statutory and/or legal obligations; and (iii) to ensure judicial protection of the Company’s rights, subject to the ordinary statute of limitations.

7 – The User’s Rights
Users, as data subjects (i.e., individuals to whom the Data refer), have rights conferred by the GDPR. In particular, pursuant to Articles 12-23 of the GDPR, data subjects have the right to request and obtain, at any time, access to their personal data, information on the processing carried out, rectification and/or updating of personal data, cancellation and restriction of processing. They also have the right to object to processing and to request data portability (i.e., to receive personal data in a commonly used, machine-readable, structured format). Finally, data subjects, where they have given their consent, always have the right to revoke their consent at any time (this, in any case, will not affect the lawfulness of the processing carried out on the basis of the consent given before revocation) and to lodge a complaint with a supervisory authority (in Italy: the Garante per la Protezione dei Dati Personali).
